Indemnification

You agree to defend, indemnify and hold harmless COMMERCIAL KINGS, LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

Shipping Disclaimer

COMMERCIAL KINGS, LLC shall not be held responsible or liable for any issues arising after the shipment of products. Once a product is shipped, we assume no responsibility for lost, damaged, or delayed shipments. It is the responsibility of the shipping carrier to handle and deliver the products in a timely and secure manner. Customers are advised to review the shipping policies of the respective shipping carriers used for their purchases. Any claims related to lost, damaged, or delayed shipments should be directed to the applicable shipping carrier. By making a Purchase through the Service, you acknowledge and agree that COMMERCIAL KINGS, LLC is not responsible for the performance or actions of the shipping carrier, and any issues related to shipment should be addressed with the shipping carrier directly. This shipping disclaimer is an integral part of our Terms and Conditions and is subject to the governing laws specified in these Terms. 

Exclusions

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.
Governing Law

These Terms shall be governed and construed in accordance with the laws of South Carolina, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Returns and Refunds Policy

Returns & Refunds Policy – Digital Products

ALL SALES ARE FINAL. NO REFUNDS. NO EXCEPTIONS.

COMMERCIAL KINGS, LLC sells non-tangible, irrevocable digital products. Due to the nature of digital goods, ALL PURCHASES ARE FINAL and NO REFUNDS, RETURNS, CREDITS, OR CHARGEBACKS WILL BE ISSUED UNDER ANY CIRCUMSTANCES, including but not limited to claims of non-use, dissatisfaction, accidental purchase, or failure to read product descriptions.

Once an order is placed and payment is successfully processed, the digital product is considered delivered and fulfilled, whether accessed, downloaded, generated, or used or not.

By completing a purchase on commercialkings.com, the customer expressly acknowledges and agrees that:

  • They are purchasing digital goods that cannot be returned

  • They waive any right to a refund, including rights typically granted under card issuer or consumer protection policies

  • Delivery is deemed complete at the time access is granted, the file is made available, or the service is rendered

This policy applies to, but is not limited to:

  • Digital downloads

  • Audio files

  • AI-generated content

  • Subscription-based digital services

  • Custom or personalized digital products

If a customer experiences technical issues accessing their purchase, COMMERCIAL KINGS, LLC will make reasonable efforts to assist in restoring access or re-delivery, but such assistance does not constitute eligibility for a refund.

Unauthorized chargebacks, payment disputes, or reversals submitted in violation of this policy will be contested with the customer’s payment provider using transaction records, IP logs, access logs, and acceptance of these Terms and Conditions as evidence.

Custom Artwork and Use of Uploaded Images

When ordering custom laptop skins, jogwheel skins, stickers, or any other customized items, you (the “User”) agree to the following terms regarding artwork and images:

  1. Uploaded Artwork and Logos: By uploading, submitting, or posting any images, logos, or other custom artwork to our website or social media platforms, you grant COMMERCIAL KINGS, LLC a non-exclusive, royalty-free, worldwide, perpetual license to use, modify, reproduce, and display the artwork for the purposes of creating your ordered products and for use in promotional or advertising materials. This may include displaying these images on our website, in marketing emails, on social media, and in other promotional formats.

  2. Promotional Use: COMMERCIAL KINGS, LLC may use the images or logos you provide in connection with promoting or advertising similar products and services to other customers. You acknowledge that COMMERCIAL KINGS, LLC will not sell or otherwise distribute your artwork beyond its use in advertising and promotional efforts for our custom products.

  3. No Compensation: By providing images or artwork, you agree that you will not receive compensation, payment, or credit beyond the fulfillment of your original order. If you do not wish to allow your artwork to be used for promotional purposes, please contact us prior to submitting your images.

Subscriptions

Subscriptions to our services are billed on a recurring basis (“Subscription(s)”). You will be billed in advance on a monthly cycle (“Billing Cycle”). At the end of each Billing Cycle, your Subscription will automatically renew under the same conditions unless you cancel it or COMMERCIAL KINGS, LLC cancels it. You may cancel your Subscription renewal through your online account management page at any time.

A valid payment method, such as a credit card, is required to process the payment for your Subscription. You must provide COMMERCIAL KINGS, LLC with accurate and complete billing information including your full name, address, state, zip code, telephone number, and valid payment method details. By submitting this payment information, you authorize COMMERCIAL KINGS, LLC to automatically charge all Subscription fees incurred through your account to the provided payment instruments.

If automatic billing fails at any time, your Subscription will be placed on hold while we retry the card on file. We will attempt to charge the card on file for up to one month before the Subscription is canceled. You will receive an electronic invoice indicating that you must proceed manually, within a specific deadline, with the full payment corresponding to the billing period as indicated on the invoice.

Please note that all Subscriptions will remain active until you cancel them via your “My Account” page (commercialkings.com/my-account), or they are automatically canceled due to failed payment attempts. Except when required by law, paid Subscription fees are non-refundable, and no credits or refunds will be issued for any unused portion of the Subscription, including when the service is not utilized. You may cancel your Subscription at any time, but you will not receive a refund or credit for any remaining portion of your Subscription period.

Advertised turn around times for services, digital products and product deliveries are average times only and not a guarantee. COMMERCIAL KINGS, LLC will not be held responsible for order delays. COMMERCIAL KINGS, LLC will guarantee the delivery of digital orders within 15 working days from date of purchase.

Revisions

COMMERCIAL KINGS, LLC reserves the right to deny any/all revision requests that do/do not fit within our revisions policy guidelines. COMMERCIAL KINGS, LLC reserves the right to deny any/all revision requests.

Security
